For a SEPA Direct Debit Core collection, the rulebook’s no-questions-asked refund window ends eight weeks after the debit date (SEPA Direct Debit Core Scheme Rulebook). For unauthorised collections, that rulebook sets a claim deadline of 13 months after the debit date. You can ask your account-holding bank to refund a Core collection without explaining your reason during the initial refund window.
How long do I have to ask my bank to refund a direct debit in Spain?
The longer claim window applies when the collection was not supported by your consent (European Payments Council AISBL).
After the initial window, the longer route is for unauthorised collections, not simply an authorised bill you disagree with (European Payments Council AISBL).
According to Banco de España, the refund deadline is different depending on whether the charge was previously authorised or not: “si el cargo estaba previamente autorizado (ocho semanas) o no (trece meses)” (¿Qué pasa si devuelvo algún recibo?).
Which Core refund deadline applies?
Situation | Rule | When the period starts |
|---|---|---|
Core collection within the initial refund window | Request a refund within eight weeks without giving a reason | The date your account was debited |
Unauthorised collection claimed after eight weeks | Submit the claim no later than 13 months after the debit | The debit date of the disputed collection |
Unauthorised collection challenged within eight weeks | The refund right applies without providing a reason | The date your account was debited |
How do I ask my bank for the refund, and what evidence do I need?
Instruct the bank holding your debited account to refund the collection (European Payments Council AISBL). For an unauthorised collection claimed after the initial refund window, submit the collection details and any supporting evidence you have.
Follow your bank’s customer instructions for submitting that claim, because the Core rulebook leaves those instructions to individual banks (European Payments Council AISBL). Your bank must examine the unauthorised-payment request and decide whether to accept or reject it.
The rulebook’s interbank settlement timelines do not determine the deadline for refunding your account under the Payment Services Directive (European Payments Council AISBL).
Does returning the payment cancel my bill or stop the next collection?
A refund does not resolve your dispute with the creditor or determine its outcome (European Payments Council AISBL). A recurring authorisation (“autorización”) covers successive charges (“cargos”) without fresh authorisation each time, until you instruct that they stop (Adeudos domiciliados).
Explain the reason for returning the payment to the supplier: Banco de España warns that otherwise it may interpret the return as cancellation of the service (¿Qué pasa si devuelvo algún recibo?). Returning bills issued by the Seguridad Social or Agencia Tributaria can cause surcharges or loss of subsidies or discounts, affecting both the returned bill and subsequent bills that ceased to be issued (¿Qué pasa si devuelvo algún recibo?).
To cancel the mandate, deal with the creditor; the Core rulebook places mandate cancellation between you and the creditor, without either bank’s involvement (European Payments Council AISBL). Separately, expressly revoke the bank’s direct-debit instruction in a document bearing a date and signature (“fecha y firma”) (Adeudos domiciliados).
According to Banco de España, the revocation only takes effect if the bank receives it before the end of the last business day before the scheduled charge (“antes del final del último día hábil anterior”) (Adeudos domiciliados). If the bank receives it later, it affects only the following bills (“los recibos siguientes”).
